Pata Hao is NOT a real estate agent, broker, property manager, or rental agency. We do not represent, act on behalf of, or hold any agency relationship with any landlord or tenant.

Pata Hao provides landlords with the ability to register and list their rental properties on the Platform solely to increase the visibility of such properties to prospective tenants. The Platform serves as a digital notice board only.

"You", "your", or "User" means any person who accesses or uses the Pata Hao website or mobile application, whether as a prospective tenant browsing listings or as a landlord registering properties.

Please read these Terms and Conditions ("Terms") carefully before using the Pata Hao platform. By accessing or using any feature of our platform, you confirm that you have read, understood, and agreed to be bound by these Terms.

If you do not agree to these Terms, you must immediately cease using the Platform.

These Terms may be amended, modified, or supplemented from time to time. Any changes will be published on our platform and shall take effect upon publication. Your continued use of the Platform constitutes acceptance of the revised Terms.

Pata Hao operates solely as a property listing and discovery platform. Our role is limited to displaying property listings submitted by landlords or their authorised representatives.

We do not verify, inspect, or audit any property listed on the Platform. We do not confirm the accuracy, completeness, safety, legality, or availability of any listed property.

Any rental agreement, lease, or tenancy arrangement entered into as a result of a connection made through the Platform is strictly and solely between the tenant and the landlord. Pata Hao is not a party to any such agreement.

Pata Hao does not collect, hold, transfer, or facilitate any payments between users and landlords. All financial transactions are entirely the responsibility of the parties involved.

Any landlord or property owner wishing to list a property on Pata Hao must register an account and submit accurate, truthful, and complete information about their property.

By registering a property, the landlord warrants and represents that:

Pata Hao reserves the right to remove or reject any listing at its sole discretion without notice, including listings that are fraudulent, misleading, illegal, or in violation of these Terms.

Landlords are solely responsible for the accuracy, legality, and completeness of their listings and all communications and transactions they enter into with prospective tenants.

Users acknowledge that they use the Platform and engage with landlords entirely at their own risk and volition. Pata Hao's role ends at facilitating the discovery of listed properties.

In the event you are a victim of fraud, you are advised to report the matter immediately to the relevant law enforcement authorities and your financial institution. Pata Hao may cooperate with law enforcement investigations but is not obligated to provide restitution or compensation of any kind.

As a user of the Pata Hao Platform, you agree and undertake to:

To access certain features of the Platform, you may be required to register an account. You are responsible for maintaining the confidentiality of your account credentials.

You are fully responsible for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

Pata Hao reserves the right to suspend or terminate any account that violates these Terms or is found to be involved in fraudulent, misleading, or illegal activity.

All content on the Pata Hao Platform, including but not limited to the design, layout, logos, trademarks, graphics, software, and text created by Pata Hao, is the exclusive intellectual property of Pata Hao and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from any Platform content without prior written consent from Pata Hao.

By submitting any content, including property listings, photographs, or descriptions, to the Platform, you grant Pata Hao a non-exclusive, royalty-free licence to use, display, and distribute such content on the Platform.

You warrant that any content you submit does not infringe any third-party intellectual property rights and is accurate, lawful, and not misleading.

Pata Hao reserves the right to remove any content that violates these Terms or that we deem inappropriate, without notice and at our sole discretion.

Pata Hao collects personal information from users for the purposes of operating and improving the Platform and providing the best possible experience.

Personal data collected may include, but is not limited to, your name, email address, phone number, location, and property details you submit.

We handle all personal data in accordance with applicable data protection laws. We will not sell or disclose your personal data to third parties for commercial purposes without your consent, except where required by law.

By using the Platform, you consent to the collection, storage, and processing of your personal information in accordance with our Privacy Policy, which forms part of these Terms.

The Pata Hao Platform and all its content are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, reliability, availability, or completeness of any information on the Platform.

Any dispute arising between a user and a landlord in relation to a property, payment, tenancy agreement, or any other matter is solely between those parties. Pata Hao has no obligation to mediate, resolve, or be involved in any such dispute.

Pata Hao will not adjudicate claims for refunds, compensation, or damages resulting from transactions conducted between users and landlords.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall first be addressed through good-faith negotiation by contacting us via the details provided below.

If a resolution cannot be reached through negotiation, the dispute may be referred to mediation before an independent mediator agreed upon by both parties.

These Terms shall be governed by and construed in accordance with the applicable laws of the Republic of Kenya.

Pata Hao reserves the right to amend these Terms at any time. Amended Terms will be published on the Platform and will take effect upon publication. Your continued use of the Platform after any amendment constitutes your acceptance of the updated Terms.

These Terms, together with our Privacy Policy and any other policies or notices published on the Platform, constitute the entire agreement between you and Pata Hao with respect to your use of the Platform.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
